Terms & Conditions

The following terms and conditions are applicable to all sales unless otherwise agreed in writing.

Carriage:

Orders over the value of £500.00 nett are delivered free (UK mainland only).  With orders under £500.00 nett, carriage is charged at £20.00.

Payments:

Settlement is due within 30 days nett of the invoice date.  Cheques should be made payable to Adaptocare Limited.  Payment may also be made by BACS transfer or credit card.

Lead Times:

Lead times are given in good faith but are affected by market demands and availability.  Please note that any lead time quoted is only for receipt of official order with full specifications and instructions to proceed.

VAT:

VAT will be added to all invoices at the current rate unless the customer provides a valid VAT Exemption Certificate.

Prices:

We reserve the right to change prices without prior notice and invoice at the price ruling at the date of receipt of order.  In the event of a price increase of more than 5%, Adaptocare will notify the customer prior to processing the order.

Catalogue Descriptions:

Adaptocare takes great care to ensure that catalogue descriptions and illustrations are clear and accurate.  Some products may vary slightly from those described.  Adaptocare reserves the right to alter designs and specifications without prior notice.  Every effort is made to ensure that all technical specifications are accurate, however, these cannot be guaranteed and are intended for guidance only.

Return of Goods:

Goods ordered in error may only be returned at the discretion of Adaptocare.  These goods must be suitably packaged by the customer for transportation and returned in saleable condition.  Goods returned without the suitable packaging will not be credited.  The cost of the initial deliver and returns of goods to Adaptocare will be borne by the customer.  All relevant paperwork must be completed and supplied at the time of returning goods.

Title and Risk:

Risk in the Goods shall pass to the customer when the goods are delivered.  The property of the Goods shall remain with us until payment of all sums due to us whether in respect of this contract or otherwise is made.

Until title passes:

  • You shall hold the Goods as our fiduciary agent and bailee.
  • The Goods shall be stored separately from any other goods and you shall not interfere with any identification marks, labels, batch numbers or serial numbers on the Goods.
  • We agree that you may use or agree to sell the Goods as principal and not mixed with any other monies or paid into an overdrawn bank account and shall at all times be identifiable as our money.
  • We shall be entitled at any time to recover any or all of the Goods in your possession to which we have title and for that purpose we, our employees or agents, may with such transport enter upon any premises, occupied by you or to which you have access and where the Goods may be or are believed to be situated.

Guarantee:

Our products are covered by the following guarantee which does not affect the customer's statutory and other legal rights.  Any products or parts failing within its lifetime under normal use should be reported directly to Adaptocare. We pledge to replace any such reported products or parts within a reasonable time scale designed to meet the Client’s satisfaction. Adaptocare will not accept a claim under this guarantee if it has been used otherwise than in accordance with Adaptocare's instructions.  The guarantee does not cover any damage due to accident, misuse or neglect.

Where the Goods are not manufactured by Adaptocare the guarantee applicable will be that of the original equipment manufacturer.  Adaptocare's shower bases and glazing panels are fully guaranteed for the product lifetime against breaking in normal use.  As we have complete faith in our products, we uniquely offer this guarantee as fully transferable.

Claims:

If, upon receipt, the Goods appear damaged or incomplete, please indicate on the carrier's documentation.  Please also notify Adaptocare no later than 3 days after delivery.  Failure to notify within 3 days will negate subsequent claims.
